Supreme Court Justice Antonin Scalia showed a lighter side while joking at an event with students from the University of California Washington center.

At the event Monday, held to publicize his new book, “Reading Law: The Interpretation of Legal Texts,” Scalia answered students’ questions on a range of issues and offered insight into the perspective from the other side of the bench.

Scalia said most times justices ask questions in order to make colleagues understand which way they are leaning a certain way on a case.

“Sometimes I ask questions just because I’m bored, just to stay awake,” he joked. “Very often the questioning is done to convey your point of view to your colleagues.”

Media, old and new, takes heat for Boston coverage

Marcus Messner, a communications professor at Virginia Commonwealth University, said the rash of mainstream media errors stemmed at least in part from pressure to compete with fast-flowing social media.

“If you look at Twitter, the news snippets on the events are a lot more advanced than what you’re seeing on websites or even what you’re seeing on the air,” Messner said. “Twitter, especially, has put a lot more pressure on news organization to get it out fast.”

In other words, old media already functioned in a careless way when any crisis erupted, to take advantage of the public’s short but heightened attention span; now they will move into even faster gear to compete with the Internet para-media commentary and articles (blogs, facebook, etc.) and other forms of instant communication like Twitter. This faster mode will certainly mean they will try to make up stories out of nothing concrete in a much more intense way. Which then just gives them more fodder to go back and correct everything they said wrong in the first place, as “updates.”

 

I very much liked my comment added to another debunking of the “born this way” (homosexual) myth. All of it below was posted on the NomBlog this week and one of the homosexual activists on the NomBlog went ballistics as a result.

Discussion of a genetic contribution has shifted to yet a more sophisticated statistical estimate, that of “heritability.” Heritability is an estimation of how much of the variability of a particular phenomenon such as sexual orientation, out of a total of 100%, may be attributed to genetic influences versus environmental influences. The higher the heritability estimate, the greater the genetic contribution.
The Långström 37 study, for instance, produced heritability estimates of”.34-.39″ for male homosexuality for their subject populations.

But what does this estimate mean?

Among the many psychological traits showing this level of heritability are a dizzying array of social attitudes including inclinations towards right-wing authoritarianism, certain measures of inclination towards religiosity or religious fundamentalism, and church attendance. One study by a giant of behavioral genetics, Robert Plomin, even examined the heritability of that most mundane and ubiquitous of behaviors, television watching, 39 and found an average heritability estimate of .45 for the proclivity to watch television, marginally higher than the typical estimate for the heritability of homosexuality.

Now you know: if you are stupid enough to believe that people are born homosexuals, you are stupid enough to believe that people are biologically determined to be couch-potatoes! There’s nothing you can do – and the same goes for your own stupidity – because IQ is also one of the “traits” that are biologically determined. Alas, you are lost.

Republican members of the Montana House Judiciary Committee voted Thursday to table a bill that would have legalized homosexuality in the state. Montana code contains an arcane piece of language that outlaws consensual intercourse between homosexuals. It’s a controversial provision, ruled unconstitutional by the Montana Supreme Court in 1997. The olden time law makes homosexuality a felony, punishable by a $50,000 fine and/or up to 10 years in jail.

The bill to strike the unconstitutional law from state code passed the Montana Senate earlier this year on a 38-11 vote. Senate debate on the bill turned emotional for a Helena Democratic Sen. Christine Kaufman, who is a lesbian.

The Montana Family Foundation opposes repeal, seeing it as part of a larger battle to subvert Montana values.

“You are dealing with one of the great moral debates we’ve been having as a society for the past 20 years and will be having for probably at least another 20 years before we finally figure out as a society where we are on this issue,” Laszloffy said, according to John S. Adams of the Great Falls Tribune.

Be sure that whatever criteria isn’t so broad that it its accidentally inclusive to vegetarianism, people with fluency in more than 3 languages, Master’s level chess players, or many other statistically uncommon, yet non-pathological behaviors.

3) Show that homosexuality meets the aforementioned criteria.

You can do #1 and #2 with no sweat, but you’d be hard-pressed to show how homosexuality meets any coherent definition of a mental illness in any manner.

People who normalize homosexuality are causing great harm in society starting with their long list of irrational dogmas about the subject.

If you want to discuss the subject, you can start by presenting the full and detailed etiology of any single case of homosexuality, with all the factors and causes for the person developing a homosexuality problem. Then you can explain how you investigated this and how you know whatever you think you know.

Be sure you define everything that is encompassed by the term “homosexuality,” unless you want to talk about something without being capable of defining it.

I believe that the narrowness and shallowness of your entire “accepted” ideology is exactly where the problem begins.

To summarize, homosexuality does not meet any definition of a mental illness, largely because its not maladaptive, there’s no obvious impairment in social functioning, gay people are generally quite happy with themselves, are able to hold jobs and form healthy interpersonal relationships with others.

At best, gay people form intimate relationships with members of the same sex, rather than the opposite-sex, **but that’s a far cry from classifying those relationships as clinically pathological**. A strong case can be made that intimate same-sex relationships are optimal for a gay person’s happiness, self-esteem, well-being, a host of other criteria.

The article makes a great comment: “The only way that homosexuality could therefore be considered a psychiatric disorder would be the criteria of failure to function heterosexually, which is considered optimal in our society and by many members of our profession. However, if failure to function optimally in some important area of life as judged by either society or the profession is sufficient to indicate the presence of a psychiatric disorder, then we will have to add to our nomenclature the following conditions: celibacy (failure to function optimally sexually), revolutionary behavior (irrational defiance of social norms), religious fanaticism (dogmatic and rigid adherence to religious doctrine), racism (irrational hatred of certain groups), vegetarianism (unnatural avoidance of carnivorous behavior), and male chauvinism (irrational belief in the inferiority of women). Heterosexuality and homosexuality are, at best, descriptions of particular variations in human sexuality. Not substantially than categorizing left-handedness as different, rather than disturbed, from right-handedness.

Nature has no intentions, no expectations, no wants, no desires, does not prescribe behavior in any manner. Any “intent” or “purpose” to attached to undirected, purposely process is baseless, anthromorphosized nonsense.

Even toying around with the fictional idea that nature knows or cares what anyone does, I doubt you could even articulate why behaving in matters “not the way nature intended” is even objectionable in the first place.

Adaptation can only be considered when there is a history of problems to adapt to. Your dogmatic kind of approach does not evaluate personal history and the development of any psychological dynamics – a blanket statement is not the same thing as proof. The question that liberals cannot answer – because of a serious lack of research ethics – is what causes a person’s psychology to degenerate into homosexuality dynamics. And it does involve, I think, concerning many individuals, asking what are these homosexual dynamics a reaction to or a product of. Just like for pedophilia, bestiality, and so many other dysfunctions. The question is what caused that person to develop those profoundly deformed and unhealthy dynamics in their minds.

There is the complete impairment of socially functioning as the heterosexuals they were born as, and that nature intended them to be. Not only socially, psychologically, emotionally, culturally/ideologically.

Many dysfunctional people are. Many harmful people are too. Many ignorant people too, many unethical or criminal people are too. In fact, the more deformed your psychology, the happier you will be if no one questions your problems, your ignorance, or your lack of ethics. This certainly applies to people with a homosexuality agenda. The more impunity for the harm they do there is, the happier they are. It’s not rocket science. And the more their lack of a conscience can be sustained with a high level of emotional comfort.

Certainly incapable of forming healthy intimate relationships with the opposite sex, and clearly incapable of forming healthy relationships with same sex individuals, since they sexualize and often interact in perverted ways towards the same sex.

As for holding jobs, seriously? How ridiculous and unprofessional are liberal “authorities” to suggest having a job makes anyone psychologically wholesome and sane? Many sexual abusers, batterers, and Nazis hold/held jobs – I guess they’re all OK – especially if they are comfortable with themselves.

No one knows why people are gay, or if there is any single identifiable “cause”; but that’s a red-herring. There’s no requirement to identify why people are gay to determine whether it fits with any clinical definition of a mental illness.

No brownie points for playing armchair psychologist. Maladaptive behavior generally comes in two flavors:

1) harmful to one’s self. Behavior which impairs someone’s ability to reach a certain goal, meet demands of life, or impair a person’s ability to care for themselves. These behaviors usually cause some kind of distress, anxiety, suffering. Severe social phobias and eating disorders would be prime examples of behaviors which cause significant distress.

2) harmful to others. Causes some significant interference with social functioning, especially if they impair a person’s ability to form or maintain relationships with others. Drinking until one blacks is strong predictor of self-harm and suicide. Can cause a person to feel worthless, lose interest in their job, alienate friends and family.

There certainly is a lot of wiggle room in how maladaptive behavior is defined, but its almost always going to coincide with some tangible suffering endured by the patient or others. Meaning, it causes the patient anxiety, distress, suffering, fear, depression, significantly interferes with the patient’s interpersonal relationships.

Does this cause gay people significant anxiety, distress, suffering, fear, depression (separate, of course, from societal disapproval)? Does it significantly interfere with a gay person’s ability to form and maintain interpersonal relationships with others, reach goals of interest to them, meet the demands of life?

All you’ve been able to say so far is that gay people don’t have sexual relationships with, but you haven’t specifically identified why that behavior is harmful, even in principle. The entire “homosexuality is a mental illness” argument falls through the floor in the utter absence of any identifiable harm suffering endured by anyone,

There are many people who have and continue to investigate why people develop a homosexuality problem and who have something you don’t have: knowledge about the causes. I see that you cannot tell the difference between your own very limited mind and everyone else’s. Someday you may realize that people aren’t clones and that not everyone is completely ignorant about factors and causes as you are. There are people who have knowledge about why individuals develop a pedophilia problem, an S&M problem, a bestiality problem, and also a homosexuality problem, among many others. No points for failing to refute my point. You cannot talk about adaptation (beneficial or detrimental) unless there is a context that requires the process. You always need a context and a time-line history in order to talk about adaptation. It is this context which contains the elements that cause the problems which require the process for adaptation. Since you fail to have any knowledge about the psychological, social, and ideological development of any individual who has a homosexuality problem, you are not in a position to assess if they have adapted in any way to any element in their life experience.

Any declaration you make that a person with a homosexual problem has “not adapted” or “has not maladapted” is just a show of your (irrational) dogmatic position. By your own admission, you have no knowledge about any analysis of the history of any individual in regard to their psychological, social, and ideological development related to homosexuality. If you are ignorant about the history of a person’s development (independently if it’s disordered and unhealthy or not), you cannot say what they have or have not adapted to, or in what way (healthy or unhealthy, harmful or not).

Although the question you ask about the definition of mental illness is very important and perfectly valid, I don’t really think that blog comment sections provide the space for discussing it.

It might be interesting to wade into a bit in any case, given how dogmatic you are in your positions 🙂 It’s always interesting to debate the subject with someone who thinks they know it all about mental illness – even if they are completely incapable of researching and understanding the psychological history of even a single individual with a homosexuality problem. These are the people we find on the Internet. Experts!

Apparently, you make no distinction between the following words: disordered, dysfunctional, deformed, degenerate, perverted, perverse, and mentally ill.

I do, although they may intersect. But if you assume that you can interchange “disordered/dysfunctional/unhealthy/perverted” with “mentally ill” any time I write any of the former, you are making a big mistake.

I don’t use “mental illness” much because there isn’t a notion of degrees of illness – it already implies a profound degree and of certain kinds only. So it’s not comparable to saying “sick” for physical illnesses as with having a cold, the flu, or pneumonia. You can say you were “sick” for all of these, but you normally don’t go around saying you are “mentally ill” any time you have some sort of psychological problem.

The concept of “mental illness” is also inseparable from (political) ideology, both culturally and socially, and it also exists within a person’s own psychology. An analysis of the historical definitions of “mental illness” shows that clearly. The definition of “mental illness” usually reflects the dominant groups in society, with all their lack of ethics embedded. This is another point you also don’t seem to realize at all.

So far, you have not been able to show that I have mischaracterized LGBT people. You have also failed to point out any irrational argument I have made.

In my opinion, it’s quite irrational to claim to be an expert on homosexuality when you are completely incapable of explaining the etiology of homosexuality for even a single individual.

You see, I would never think a person who is completely incapable of explaining why an individual rapes or develops anorexia or tortures animals is a psychology expert in these subjects. Likewise, I fail to see any expertise from your part regarding homosexuality. Normalizing it is not explaining it.

I can see that you are just repeating what you were told in your little homosexuality agenda pamphlets, but that’s not the same as being able to think about what’s written there. Dr. Ben Carson, a neurosurgeon and recent star of the conservative movement, has apologized for comments on homosexuality that had Johns Hopkins students clamoring for his ouster as their commencement speaker.

During a March 26 TV interview with Fox News’s Sean Hannity, Carson compared homosexuality to bestiality and pedophilia in explaining his view that “marriage” can only describe a heterosexual relationship.

“Marriage is between a man and a woman, it’s a well established fundamental pillar of society,” Carson told Hannity. “And no group, be they gays, be they NAMBLA, be they people who believe in bestiality, it doesn’t matter what they are. They don’t get to change the definition, so it’s not something that’s against gays, it’s agianst anybody who wants to come along and change the fundamental definitions of pillars of society–it has significant ramifications.”

Today, Dean of medical Faculty Paul Rothman called the comments “offensive” in an open letter and announced that faculty would meet with graduating students to discuss the matter. Carson, meanwhile, apologized.

Homosexuality should be compared in the way Carson did because these are three dysfunctions related to sexuality.

Dr Carson has nothing to apologize for.

Heretics must be forced to apologize and burn at the liberal stake.

The normalization of homosexuality must be shoved down everyone’s throats.

And to have this Paul Rothman complain – obviously the dean of medical faculty is the most ignorant faculty of all.

Wow. I suppose this is news to me only (although I have probably come across brief mentions of it before when reading other historical stuff, but didn’t really realize how much more there was to it). But there it is. I find it fascinating.
A Rennaissance special ops force to go raid foreign libraries for their books. Not silver, not gold, but books.

And they had rules (international treaties) to regulate the particular circumstances that allowed the raider to then keep or not the booty! That’s funny. Modern version: OK, so if by 7 o’clock I have parked your stolen car in my garage, it’s mine, and I get to keep it.

Entire libraries were raided and stolen! They didn’t have the money to purchase the books, so, logically, RAIIIID!

Looting in Prague

In the early morning of 16th July 1648, during the very last stages of the Thirty Years War, a Swedish force one hundred strong, commanded by the Imperial renegade Ernst Odowalsky, scaled the city wall of Prague’s Kleinseite on the west bank of the Moldau. Overpowering the unsuspecting guard, the Swedes made their way through the Strahov gate. Soon afterwards 3,000 men flocked into the Kleinseite. The castle and a number of aristocratic palaces, in which both the Emperor and the Austro-Bohemian nobility had amassed great quantities of valuables, were at the troops’ mercy and were systematically looted. The haul was immense. Apart from a host of invaluable art objects, the Imperial Treasury contained a number of valuable illustrated works and rare manuscripts. The inventory drawn up at the time mentions 100 an allerhand Kunstbüchern (‘a hundred art books of different kinds’), among them two world-famous manuscripts: Codex Gigas and Codex Argenteus (the Silver Bible, now in Carolina Rediviva, Uppsala). The Emperor’s library, mainly from the time of Rudolph II was also looted, as was the princely Ursini-Rosenberg collection of books, one of the very finest at that time, which had been transferred to the castle only the year before. The Praemonstratensian monastery of Strahov, the Jesuit College and several aristocratic palaces were ransacked as well.

Codex Gigas is carried off to Sweden

All the booty was quickly inventoried. On Queen Christina’s instructions these were shipped down the Elbe to the Baltic coast during the autumn. Time was short, because in the Osnabrück peace talks it had been settled that all booty which had not been carried off when hostilities ended was to be returned. The peace treaty was signed in Münster in mid-October 1648. The booty was stored during the winter in the border fortress of Dömitz, Mecklenburg, and at the end of May 1649 it reached Stockholm by way of Wismar where the Queen waited impatiently. She had made plans to enlarge the royal castle to make room for the new treasures. Isaac Vossius, her librarian, was tasked with arranging the books captured in Prague. He finished the work in March 1651, having catalogued some of the books and all the manuscripts. His catalogue starts with Codex Gigas. Most of the books ended up in the royal castle library, but some became the private property of Swedish and foreign officers. Some were given to Christina’s favourites and some in lieu of salary to her librarians. Other books went to the Swedish university and grammar school libraries, and probably also to Dorpat (Tartu) University.

The Queen eventually took the most valuable books and manuscripts with her when she left the country. The majority of those items are now in the Vatican Library. Much of the booty that remained in Sweden later perished in a number of fires while some was sold at book auctions in the eighteenth century. But a portion has survived and is now mainly in the Royal Library, Stockholm, in Uppsala and in Lund University Library.

The archival records which Königsmarck, acting on the government’s special instructions, laid hands on was incorporated with Riksarkivet (the Swedish National Archives) in Stockholm in 1653. Only a fraction of it now remains, some of the documents having been returned and others destroyed in the Royal Castle fire of 1697.

War booty as a method of acquisition

Queen Christina was a passionate book collector who acquired large numbers of books by purchase but greatly enlarged her library by means of war booty. This was a recognised method of acquisition at the time and had been successfully tested by Christina’s father, Gustavus Adolphus, who made his campaigns between 1621 and 1632. These were excellent opportunities for enriching Swedish libraries and especially that of Uppsala University. Sweden did not have money to spend on new acquisitions and had limited access to newly published literature. This war-booty came as a substantial increment to the newly established university library. In addition, the looting of Jesuit book collections was regarded as fair play in the struggle against the Catholic Counter-Reformation.

During the regency administration, between 1632 and 1644, Axel Oxenstierna issued detailed instructions to Swedish military commanders for the confiscation of fine libraries. These were to be sent to Sweden, preferably in their entirety. He particularly urged the field chanceries to seize manuscripts. Charles X and Charles XII, Queen Christina’s successors to the throne of Sweden, both continued the taking of literary war booty on their campaigns.

All this was governed by political, denominational and crass pecuniary considerations. The books captured as war booty represented a wide spectrum of subjects from classical authors and legal literature, canon law included, to works on medicine. All this included many works of a purely Catholic nature, whereas works by Protestant authors were few and far between.

Poland, Germany, the Baltic States and Denmark were very hard hit by the Swedes’ depredations, but Bohemia and Moravia were robbed of perhaps the most exacting prizes.

Actually this kind of raid is the opposite of the wholesale theft of works that should be in the public domain today, but aren’t, thanks to the greed of the Walt Disney Corporation (and publishing cartels).

During the mid-1990s, the giant Disney Corporation became concerned that its 1928 copyright on Mickey Mouse was close to expiration.  Deploying heavy lobbying efforts, it persuaded Congress to pass and President Bill Clinton to sign what was officially entitled the 1998 Sonny Bono Copyright Term Extension Act, but more informally known as the “Mickey Mouse Protection Act.”  The result was to extend Mickey’s copyright for another twenty years, and perhaps indefinitely if future corporate lobbying efforts bore similar fruit.

… As a direct consequence, the continuous yearly expiration of old copyrights came to a screeching halt at the year 1922, and has moved no further in the last fifteen years.

Where’s the public mobilization against this? Americans are daft, I tell you. (In the UK, same problem, btw).

Get it into the public domain now.

(At last, one article at TAC which is not a liberal attacking social conservatives and is actually worth reading – I was banned at TAC by Rod Dreher recently by the way. I am waiting to have a little more time to blog to write about it. See my other blog in the comment exchange with ARt Deco for now).
